Website Ownership, Cancellation & Transfer Policy

A plain-English overview of how website ownership, cancellations, provider transfers, and nonpayment are handled for Mission City Digital clients.

Effective date: September 11, 2026

This policy explains how website ownership, service cancellation, transfers to another provider, and nonpayment work for Mission City Digital clients. If you have a signed client service agreement, that agreement controls if it conflicts with anything in this general policy.

1. Client ownership

The client retains ownership and control of its domain name and should be listed as the domain registrant whenever practical.

The client owns its logos, trademarks, photos, videos, copy, and any other materials the client supplied or already owned, as well as its customer and lead data.

Mission City Digital may be authorized to administer domains, DNS, email configuration, and related services while the account is active. Managing these services on the client’s behalf does not transfer domain ownership or intellectual-property rights to Mission City Digital.

2. Managed website service

The setup fee covers the design, configuration, implementation, and launch of a managed website. It is not automatically a purchase of unrestricted ownership of the underlying project, source code, platform account, or third-party licenses.

The $99 per month managed service may include hosting, SSL/security, maintenance, reasonable or basic updates, analytics, support, and related ongoing services according to the client’s service agreement.

Third-party software, libraries, fonts, stock assets, platform services, and licenses remain subject to their own terms and are not transferred beyond what their licenses permit.

3. Voluntary cancellation

A client may cancel the managed website service with 30 days’ written notice, unless its signed service agreement states otherwise.

The site generally remains active through the paid service period, subject to the account being current.

Mission City Digital will reasonably cooperate with offboarding, including domain/DNS transition and transfer of client-owned materials, as outlined below.

4. Moving to another provider

The client’s domain remains the client’s property. Mission City Digital will reasonably cooperate with DNS and domain transition to the client or a new provider.

The client is entitled to its client-supplied materials and its business/lead data in a reasonably available format.

Transferability of the actual website, source code, or project is subject to technical, platform, and licensing limitations. Some components may not be movable as-is.

If the client wants transferable website or project assets during the first 24 consecutive months of managed service, the following buyout schedule applies unless a signed agreement says otherwise:

  • Months 1–12: $995 website transfer/buyout fee.
  • Months 13–24: $495 website transfer/buyout fee.
  • After 24 consecutive paid months: no additional website buyout fee for transferable website assets.

Third-party subscription accounts, licenses, and non-transferable platform components may need to be recreated, replaced, separately licensed, or transferred according to the provider’s rules. Mission City Digital does not promise that a Lovable project itself, or any specific platform project, is always transferable.

5. Nonpayment

If a payment fails or is overdue, the following sequence applies:

  • Day 1: Payment notice and request to update payment information.
  • Day 5: Second reminder.
  • Day 10: Mission City Digital may suspend website hosting and managed services until the account is brought current.
  • Day 30: The account may be terminated for nonpayment.

Mission City Digital will generally retain an available website backup for at least 30 days after termination before deletion, subject to technical and storage limitations and any legal requirements.

Restoration after suspension or termination may require payment of outstanding balances and any reasonable restoration or reconnection costs disclosed to the client.

Domain ownership is not forfeited because of unpaid Mission City Digital service fees. Mission City Digital will not intentionally hold a client-owned domain hostage as collection leverage. However, registrar and domain charges must be paid to the domain registrar to keep the domain registered and active.

6. Transfer requirements

Before a transfer, the client must pay any undisputed outstanding Mission City Digital service charges and any applicable website buyout or transfer fee under the agreement or this policy.

Mission City Digital should provide reasonable cooperation for domain/DNS transition and transferable assets.

After transfer or termination, the client or new provider becomes responsible for hosting, security, maintenance, email, backups, software compatibility, and functionality.

Mission City Digital is not responsible for changes, outages, or issues caused by the client or new provider after control is transferred.

7. Data & backups

Clients should retain their own copies of important business data and content.

Mission City Digital performs reasonable backup retention as part of the managed service, but does not guarantee indefinite archival storage.

Lead and customer data should be exportable when technically available, subject to applicable privacy and legal obligations.

8. Fair dealing

Mission City Digital is purpose-driven in how it serves clients. The goal of this policy is to make transitions professional and fair, protect client-owned property, and avoid trapping clients, while also protecting Mission City Digital’s work, platform costs, and unpaid fees.
